Terms of Use

1. Introduction and Acceptance

  • By accessing Recess, users, including students (Learners) and tutors, agree to these Terms and Conditions.

  • These terms apply to all individuals engaging with Recess, including users of the Recess Pathway platform, where personalized, structured learning and career-oriented courses are provided.

  • Users must be of an appropriate age, and parental consent may be required for minors.

2. Account Creation and Usage

  • All users are responsible for providing accurate and up-to-date information during account creation.

  • Tutors, in particular, must ensure that all information supplied during their application to join Recess is accurate and true.

  • Users are responsible for safeguarding their login credentials, and Recess cannot be held liable for unauthorised access due to misuse.

3. Subscription and Payment Terms

  • Recess Pathway Subscriptions: Subscriptions to Recess Pathway are billed on a monthly basis. Subscriptions are non-refundable but may be canceled anytime with no penalties.

  • Learning Packs: Non-refundable, no expiration, and remain available for future sessions. Cancellations made over 24 hours before a session will credit the user’s wallet with the session. Cancellations made with less than 24 hours’ notice will not be refunded or credited.

  • Session Issue Resolution: If an issue arises during a session, users are encouraged to contact Recess Support, where cases are assessed, and credits may be provided if necessary.

4. Tutor Requirements and Payment Processing

  • Application Requirements: All tutors must provide accurate and factual information during the application process. Approval is contingent upon a review by the Recess team.

  • Payment via Stripe: Tutors must create a Stripe account to process and receive payments for services rendered on the Recess platform. Monthly payouts are processed if earnings reach a minimum of $300 during the previous billing cycle.

  • Billing Cycle: Tutors are paid once per month, provided they meet the earnings threshold. Recess is not liable for any fees associated with Stripe or delays due to third-party processing.

5. Community Guidelines

  • Recess upholds a safe, inclusive, and respectful environment, with the following guidelines for all users:

    • Respectful Communication: No discriminatory, offensive, or inappropriate behaviour will be tolerated. Users must refrain from using demeaning language or offensive comments.

    • Confidentiality and Privacy: All session conversations are confidential. Sharing personal information to conduct sessions outside Recess violates these terms and may result in account suspension or termination.

    • Accurate Information: Tutors are expected to provide factual and accurate information at all times. Misrepresentation or misinformation is a serious offence and can lead to removal from the platform.

    • Platform Exclusivity: Users are prohibited from arranging or conducting sessions outside the Recess platform. Any breach of this policy will result in immediate action.

6. Course and Resource Availability

  • Course Updates: Recess may add, remove, or modify course offerings without prior notice to ensure content remains relevant to industry needs and educational standards.

  • Backpack Partner Discounts: Discounts with Backpack resource partners are exclusive to Recess Pathway subscribers. Discounts and offers may vary and change periodically, with no obligation to notify users of these changes.

  • Notifications: Users may receive platform notifications regarding session confirmations, tutor availability, course updates, and important platform improvements.

7. Privacy and Data Protection

  • Data Security: Recess priorities the privacy and security of user data, which will not be shared with third parties unless legally required.

  • Session Review: In cases where a violation is reported, Recess may review session data to ensure compliance with the platform’s guidelines.

  • Payment Information: Payment information is processed securely through Stripe. Recess does not store full payment details, maintaining compliance with privacy regulations.

  • Data Usage: Personal data is collected and managed according to the Privacy Policy. Recess is committed to user privacy and follows data protection best practices.

8. Conduct and Interactions on Recess

  • Session Reviews: To maintain quality and security, Recess reserves the right to review session data when issues or violations are reported. This is conducted solely to ensure user safety and compliance.

  • Dispute Resolution: Users should reach out to Recess Support if any issues arise. Recess will work with both parties to reach a resolution that aligns with platform guidelines and community standards.

9. Intellectual Property and Content Usage

  • All Recess content, courses, and resources are the property of Recess and/or its partners and are protected by copyright laws.

  • Users are prohibited from copying, distributing, or modifying any materials for uses outside personal learning purposes.

10. Liability and Disclaimers

  • Recess strives to provide reliable, quality experiences but does not accept liability for technical errors, missed sessions, or issues stemming from user content.

  • Recess is not responsible for any third-party products, services, or content accessible through resource partners or other external affiliations.

11. Amendments

  • Recess reserves the right to amend these Terms and Conditions as the platform evolves. Efforts will be made to inform users of any significant changes, especially those impacting user experience or service delivery.
